PRIVACY POLICY

QB HIT LIST

1. GENERAL MATTERS

Overview. Welcome to the QB Hit List web site (“Site”). We have adopted the following Privacy Policy (“Policy”) to advise you of your choices regarding the use of your personal information online. By accessing and using this Site you agree to this Policy and our Terms of Service. Please note, QB Hit List, LLC, (“QB Hit List”) the company that owns and operates this Site, reserves the right to change this Policy at any time for any reason without notice. By continuing to use the Site you agree to be bound by any such revisions and should therefore periodically visit and print the latest version of this Policy for your records.  For your information, the date of the last update to this Policy is posted at the top of this page.Scope of Policy.  This Policy only applies to this Site and does not apply to any third party websites to which we link. You should carefully review the privacy policies of those web sites in order to determine how they treat your personal information. This Policy applies to website visitors who simply browse the Site without registering (each a “Guest”) and to those who subscribe and become members of the Site (each a “Member”) collectively we refer to a Guest or a Member as a visitor (“Visitor”).

2.  COLLECTION OF VISITOR PERSONAL INFORMATION

Except for the Default Player Profile Page as further described below, QB Hit List does not use or collect any personally identifiable information from Visitors unless you voluntarily choose to disclose such information while taking advantage of the services on the Site.  Personally identifiable information may include a Visitor’s name, e-mail address, phone number, postal address, credit card number, gender, date of birth etc. (“PII”).  You will be asked to disclose PII if: (i) you subscribe to become a Member of the Site during the registration process; and/or (ii) if you purchase products, services offered on the Site.  If you choose not to become a Member you may still visit portions of the Site but may not be able to access certain areas which are reserved for our Members.

3. HOW WE USE YOUR PII

Membership Subscription.  PII is used to facilitate our services in creating individual player profiles that can be viewed by Visitors.

Payment Information.  Additional PII such as payment information may be collected in order to process your membership, subscriptions and any product purchases.

Transaction Information.  PII may also be collected by us to track transactions conducted on the Site including what level membership you select and information we require for payment.

Requests.  If you direct comments or questions to us or request information from us, we may ask you to verify certain PII to ensure that you are the individual making the request.

Initial Profile Page.  QB Hit List has generated initial player profile pages (“Initial Player Profile Page”) that can be seen by Visitors without registering to become Site Members.  The Initial Player Profile Page includes publically available statistics about individual athletes such as a player’s first and last name, high school, demographic location, age, weight, height and class. Any individual with an Initial Profile Page may request to have their Initial Player Profile Page removed from the Site via email to customerservice@qbhitlist.com.

Member Profile Page. A Visitor has the opportunity to become a Member of the Site to take advantage of the many services we offer including creating a Membership Profile Page as further described below.

4. POSTED INFORMATION AND CONTENT

Visitor Posted Content.  You may post content to some portions of the Site such as your Member Profile Page, message boards and/or public forums.  User content is posted at your own risk.  While QB Hit List limits access to certain pages on the Site, please be aware that no security measures are perfect or tamper proof.  Additionally we cannot control the actions of other Visitors with whom you may choose to share your content and information. QB Hit List is not responsible for the circumvention of privacy settings or security measures contained on the Site and nor any third party use of content and/or information you post on the Site. Do not post any content or information that you expect to remain confidential.

Member Profile Page.  A Member profile page (“Member Profile Page”) is created by Site Members.  These pages include additional information and content provided by the Member and are viewable by all Site Visitors.  Each Member can control what is on the Member Profile Page and can control how other Members and QB Hit List communicates with them. Members can edit their profiles and change their account settings by logging into their account and clicking on “Edit Profile.”

Message Boards/Bulletins Boards/Public Forums.  Visitors who use Site message boards, bulletin boards and/or public forums should be aware that when they disclose any information, including without limitation any PII, and any content on a forum, message or bulletin board or any other interactive area on the Site where information and content may be posted, the information and content can be seen, collected and used by third parties.  There is no expectation of privacy when you participate in these interactive portions of the Site. QB Hit List makes no representations or warranties and undertakes no obligations to secure the privacy of any information, PII and/or content that you post on these portions of the Site.

Email/Mobile/SMS/Social Network Communications. QB Hit List encourages Members to use best practices with respect to any email communications, SMS Text communications, mobile communications, social network communications, security and privacy.  QB Hit List cannot control and makes no representations or warranties and has no obligations to protect the privacy and security of any information that is communicated by a Member utilizing email, mobile, SMS, Text, social network communications in connection with the Site.

5. OPT-OUT

Every email communication we send you will contain a clearly worded “Opt-Out” link allowing you to withdraw your permission for future e-mails. This system is automated and must be contacted from the email address you wish to have removed. Permission changes will be honored as soon as possible after receipt. Please allow seven to ten business days for processing. Permission changes will not effect any information which you previously provided to us and which we previously shared with our business partners.

6. COLLECTION OF NON-PERSONAL AGGREGATE DATA

We gather non personally identifiable information (“Aggregate Data”) with respect to our visitors’ use of the Site to determine the extent to which our visitors use certain parts of the Site, which, in turn, enables us to make the Site as useful as possible. We may provide Aggregate Data about the use of our Site with our business partners.

7. COOKIES, BEACONS AND IP ADDRESSES

Cookies. We use a technology called “cookies” on the Site. Cookies are pieces of information that are sent to your browser from a web server and stored on your computer’s hard drive for record-keeping purposes. Cookies collect technical data and identify your operating system and session ID. They can also save information you may have previously provided and help us recognize your computer when you return to the Site. Cookies are not linked to your PII and do not identify anything personal about you.

How Can One Disable Cookies? Most browsers are initially set up to accept cookies. If you prefer, you can reset your browser to notify you when you’ve received a cookie or, alternatively, to refuse to accept cookies; however, this may limit your ability to take full advantage of the features offered on the Site.

Third Party Advertiser Cookies.  We may use third-party advertising companies to serve our ads on the Site. These third-party advertising companies employ cookie and Clear Gif technology (aka 1×1 Pixel .gifs, Web bugs) to measure and improve the effectiveness of ads for their clients. If you want to prevent a third-party advertiser from setting and/or reading cookies on your computer, you should contact the applicable advertiser directly.

Web Beacons. We may use web beacons, which allow our partners to place a cookie on an end user’s computer when they visit one of our partner sites so that when the end-user visits our Site, that cookie data is tracked by our partner and our partner can identify that the end-user achieved a certain milestone. This is a tracking concept used commonly on the Internet, also referred to as “pixel tracking.”

Session ID. We may collect end-user data based off of a session ID.  This is how we organize answers to our questions. This in-house convention allows us to use an end-user’s session ID to see all of the end-user input during the subscription process.

IP Addresses. We collect and analyze traffic on our Site by keeping track of the IP addresses of our Visitors. IP addresses are unique numeric identifiers that are assigned to each computer browser accessing the Internet. An IP address, by itself, cannot identify you personally. However, when combined with other information provided by your Internet Service Provider (ISP), your IP address can be used to identify the computer originating a message.

8. WHO HAS ACCESS TO YOUR PII

Business Partner.  Certain products and services are offered on our Site from our Business Partners.  When you purchase these products and services your PII goes directly to the Business Partner and you become their customer and are subject to their privacy policies. We encourage you to review these companies’ privacy policies and only do business with those who adhere to personal information practices with which you are comfortable.

Service Providers.  Sometimes third party service providers are retained or utilized by us and may have access to our Visitors’ PII. This information is required in order to fulfill and deliver product orders placed on our Site. Please be aware, while we take steps to protect third party use of PII through confidentiality agreements and restrictions on access to and use of such information, there is no means for us to police the activities of third parties’ use of PII disclosed to them.

Disclosure Exceptions.  We reserve the right to disclose your PII if we are required to do so by law or we believe that such action is necessary including, without limitation:

  • To comply with a legal process, such as a search warrant, subpoena or court order;
  • To protect QB Hit List’s rights and/or property;
  • To investigate reports of Visitors providing false or misleading information or sending material using a false e-mail address or sending harassing, threatening, or abusive messages;
  • To protect against misuse or unauthorized use of our Site and/or services;
  • To investigate reports of credit card fraud or unauthorized use; or
  • During emergencies, such as when we believe someone’s physical safety is at risk.
9. SECURITY

Electronic Security.  The security of your PII is important to us. When you provide PII including, without limitation, your credit card number during the membership subscription process, we encrypt the information by using advanced encryption technology known as Secure Socket Layer (SSL) to protect the transfer and storage of your PII.

Physical Security.  All PII is restricted in our offices. The servers on which we store PII are kept in a secure environment. Our main servers are operated from a dedicated third party Internet hosting facility with industry standard security features.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, while our partners follow accepted industry standards and implement reasonable security practices to protect PII, we cannot guarantee its absolute security.

10. CONTROL OVER YOUR PII

Visitor.  If you are a Site Visitor and do not want your Initial Player Profile posted on the Site contact us at customerservice@qbhitlist.com and we will remove it from the Site.

Member.  If you are a registered Member, you have the ability to review and correct your PII at any time. Simply sign into the Site and click the “Account Settings ” and click “Edit Profile.” There, you can change your address information, e-mail type, sign-in and permissions.  If you would like to terminate your account you may do so by clicking “Cancel My Account” on your account settings page.  If you terminate your membership account be aware that your Member Profile Page and any content you submitted may be removed from the Site and our servers.

Parent.  If you are a parent of any individual under 18 years of age and you would like an Initial Profile Page or Member Profile Page taken down from the Site or edited please contact us at customerservice@qbhitlist.com and we will remove or edit that content as quickly as possible.

Updates.  If your PII or email address changes or you want to edit or update your information you may do so at any time by emailing our Customer Support or by contacting us by email at customersupport@qbhitlist.com.

Implementing Change Request. We will use reasonable efforts to make the changes you requested but it is not always possible to modify database information. In addition, if your PII and email address has been provided to third parties, we will not be able to make changes to it. Further, such information is never completely removed from our database due to technical constraints and the fact that we back up our systems. Therefore, you should not expect that all of your PII Information would be removed from our database in response to your request.

California Residents. As of January 1, 2005, California Civil Code Section 1798.83 permits visitors of these Sites who are California residents to request certain information regarding disclosure of their Personal Information to third parties for direct marketing purposes. To make such a request, please send an e-mail, or contact us by telephone or send a letter to the numbers and addresses included above.

Non US Residents.  This Site is not intended for use by anyone who is located outside of the United States of America.

11. CHILDREN

COPPA Compliance.  QB Hit List does not knowingly market to our collect information from children under 13 and complies with the requirements of The Children’s Online Privacy Protection Act (“COPPA”). If you are under 13 please do not register to become a Member or send any information about yourself to us including, without limitation, your name, email address, home address or credit card information.  If we learn that we have collected information from a child under 13 without parental consent, we will delete that information as quickly as possible.  If a parent or guardian becomes aware that a child under 13 has provided us with information and/or posted content on the Site without their consent, he or she should contact us at customerservice@qbhitlist.com and we will delete such information as quickly as possible.

CHILDREN 13-17.  We recommend that children aged 13-17 should get their parents’ consent prior to becoming a Site Member and/or posting any personal information and/or content on the Site. If a parent or guardian becomes aware that a child between 13 and 17 has provided us with information on the Site without their consent, he or she should contact us at customerservice@qbhitlist.com and we will delete such information as quickly as possible.

12. OTHER MATTERS

Third Party Links. This Site may include links to other websites or utilize social networking sites that are not owned by QB Hit List.  QB hit List does not endorse or recommend any content or services of any third party websites and is not responsible for any content or services in connection therewith.  We encourage you to read the privacy policies of any third party website when you visit them.

Do Not Share Disclosure. We do not sell, rent or trade your PII or email address with third parties for their promotional purposes. However, we may use the information to direct traffic to approved partner sites. If that practice were to change, we would offer you the means to opt out of this type of information sharing.

Data Retention.  QB Hit List retains member information and profile pages for so long as a member has an active subscription.  When a Membership Account is terminated, QB Hit List has no obligation to store and will not store any PII on its database.

Sale of Assets. If we are ever sold, acquired, merged, liquidated, reorganized, or otherwise transferred, we reserve the right to transfer our databases, together with any PII or email address contained therein, to a third-party acquiring our company assets. If we do so, we will place a prominent notice of the sale on the homepage of our Site, with links to information as to how you can change your privacy preferences.
